I was just reading an article in the Dec. 19th NY Times of state attorney generals who are being coaxed to hire private firms to do
the leg-work in bringing suits against private companies, by Eric Lipton
The attorney generals are wined and
dined by the firms as well as being paid in the way of having money added to
their re-election campaigns. There are also monies paid to the state attorney
general's private charities. There were political overtones pointing at certain
political parties who are on the rise with this practice.
What is in it for the
lawyers who do this sophisticated ambulance chasing? A 10-15% contingency fee is
paid after the collection of the monies from the deep pockets in millions of
dollars in fines. The companies being sued have reciprocated making it more
difficult to initiate suits with countersuits against the practice filed at the state level against this practice initiated in the 90's against Tobacco Companies. Several Attorney Generals have been prosecuted. One has done time from Texas with no surprise being a Democrat.
There has been legislation passed making it more difficult
to sue companies in certain states. It has a political penalty for those
attorney generals when the revelation is exposed such as in newspapers , getting
e-mails and looking at financial records. Some state attorney generals have
lost their jobs, after exposure in these shady deals. Potential suits against
companies who make pain killers have been minimal because of these counter
actions with more suits being directed at private doctors who attempt to treat
pain. Yet murderous law enforcement individuals are not indicted by local or state grand-juries. This was prophesied in Fanon's book "Wretched of the Earth". The politics are not right with police unions being the main counter-punch.
What if the suit were against individual doctors by the
Feds? You know "the People of the United States do hereby sue ________, initiated by the local Federal process? What if there was no evidence of
wrong doing found by county and state authorities? What if it were revealed that evidence had been tampered with? Of course no indictments
applied to the “ before entrapment” and
solicited lying done by those convicted
of other crimes to get lower sentences. What if defense attorneys participated in
getting indictments to generate more legal fees? What if self-
appointed opportunistic “community leaders” who participate in law enforcement
were involved for some of the post-conviction spoils such as control of spouses, property and assets seized? Would this not be conspiracy which is so commonly utilized to put people in jail.
This activity is prophetically commented on in the Gulag
Archipelago by Stolchenetzen when he
reports on " pre wall fall " USSR activity of “administrative actions” against certain people in
the community who did not go along with the yoke –doke, or who practiced “out of the box but legal
methods of “practicing their art. Some of this is veiled activity by organizations
such as the Texas Medical Board who deal in administrative activities such as license revocation and reporting to National Data bases PRIOR to any trial by jury guaranteed by the Constitution.
I won’t hold my breath to see this information revealed in
the Houston Chronicle. I will also not expect to see any aspect of this process
being revealed if it is occurring in the
Federal system against individuals. There is no financial incentive. There is profitable enough motivation and
comfort in participating in scandal against individuals since the internet has taken advertising dollars. Papers do not sale without
scandal. This scandal is intensified in word for reporting on the TV news There are more dollars for Hearst Publications such as the Houston
Chronicle to do unsubstantiated articles against individuals and then repost
them in Chron.COM, after the TV news programs' reporting for future reference to circumstantial evidence and associations with those who do crimes. These dollars are solicited from individual local companies to
bring up old scandal in such online activity as
Chron.com. based on online references available to whoever wants to pay and participate. Again individuals are less likely to question and sue against
this activity .Again in summary the scandal and “professional hit” type writing sells more
papers, for TV news programs and reposting in profit seeking online publications such as Chron.com regardless of jounalisstic principle.
This is particularly true against individuals who are not politically connected to strange
bed-fellows.
